Fair Use

Fair use is the safe harbor that allows for the use of protected materials under certain circumstances. There are four (4) conditions that should be considered when applying the priciples of fair use to any use of copyrighted work(s). A good discussion of the factors to consider in a fair use analysis is available at Georgia Harper's ever popular site at the University of Texas.

The Conference on Fair Use (CONFU) produced no consensus between the participating publishers, librarians, educators, and government officials. The final report to the Commisioner is available.

Stanford has a nice fair use site that is searchable and contains links to case law and other legal materials. If you really want lots of legal stuff you can try FindLaw.com.

The folks at CETUS advocate for "an expansive and flexible view" of Fair Use in Higher Education. Read all about it here.
